Nolli Hedira Neal Jr., 33, faces the same charges, plus possession of firearms in furtherance of a drug trafficking crime. That crime has a mandatory minimum five-year sentence.

Court documents allege the two men moved more than 500 grams of a mixture containing methamphetamine, and that Nolli Neal Jr. distributed approximately 315 grams across four dates. He is also accused of possessing a handgun and two rifles for the purpose of benefiting his drug operation.

The two men were arrested and charged in Grand Forks County District Court in March. Their local charges have since been dismissed, after federal authorities took over earlier in the summer.

Nolli Neal Sr. plans to plead guilty to both of his charges in exchange for a plea agreement, though the sentence length will not be determined until his pre-sentence investigation is complete.

Nolli Neal Sr. agreed to waive his right to an appeal. A waiver and sentencing hearing is scheduled for Oct. 31.

Nolli Neal Jr. maintains his innocence and is scheduled to stand trial on Jan. 14.
